This action stems from ongoing violations of the Circuit Criminal Division Media Coverage Plan, which was established in 2020 to regulate media activity during court proceedings. The new order highlights the court’s commitment to ensuring the safety and privacy of all parties involved in judicial processes, including victims, defendants, witnesses, and court personnel.
Why This Order Was Issued
The Tenth Judicial Circuit has observed a troubling rise in unauthorized photographs and recordings taken inside courthouses, many of which have been shared on social media. Such actions undermine the integrity of judicial proceedings, disrupt court operations, and pose potential risks to individuals involved in cases.
Key Provisions of the Order
1. Cell Phones and Electronic Devices Prohibited in the Criminal Justice Center
Effective January 6, 2025, the possession or use of portable electronic devices—including cell phones, tablets, and other recording-capable devices—will be strictly prohibited in the Mel Bailey Criminal Justice Center (CJC). Violations may result in:
Temporary confiscation of the device,
Removal from the courthouse,
Arrest or criminal contempt charges,
Fines or penalties under Ala. Code § 13A-10-130 (Interfering with Judicial Proceedings).
Exempt individuals, including court personnel, licensed attorneys, law enforcement officers, jurors, and credentialed media, may possess devices but are still prohibited from using them for photography, filming, or recording.
2. Secure Device Storage Options
Individuals arriving with electronic devices must either return them to their vehicles or, if that is not an option, utilize court-provided secure packaging. These tamper-resistant packages will safeguard devices while preventing their use within the courthouse.
3. Extended Media Restrictions in Other Courthouses
The provisions of the Civil Media Plan, adopted in 2020, are now extended to the Main Courthouse and Domestic Relations Court in Jefferson County. Violations of these plans may lead to penalties similar to those in the Criminal Justice Center.
